Truck Accidents

  • Brian Brandt Wins $150 Million Verdict for Young Client.

The Law Offices of Brian Brandt, representing the plaintiffs in a wrongful death lawsuit, fought vigorously for a young victim and her brother, who was 14 years old when he died on June 6, 2013. On November 22, 2009, her and her brother witnessed both parents as well as their 14-year-old brother, burn to death in a horrific truck collision on the 210 Freeway, just east of the Sunland Boulevard exit in Southern California.

A truck driver, who was driving for Watsonville-based Bhandal Bros. Trucking Inc., had pulled his 18-wheeler off the 210 Freeway and onto the shoulder. He did not turn on the lights of the truck or put out reflectors when he stopped. The family was driving in a GMC Yukon, pulling a utility trailer. At approximately 5 a.m., the father hit a piece of debris, causing the left front tire of the trailer to blow out. In an attempt to make an emergency stop, he pulled onto the shoulder of the freeway and crashed into the back of the Bhandal Bros. Truck. The three victims-the parents and young son-became trapped when the vehicle got stuck under the truck. Only the girl and her brother managed to escape through a broken rear window before the Yukon caught fire.

A motorist who stopped to help tried using a fire extinguisher, dousing the engine with dirt, and calling authorities twice. The motorist also attempted to free the mother, who was pleading for her life, but the fire spread quickly and engulfed the vehicle. During this entire frightening ordeal, the truck driver remained in the truck’s cab.

As lead counsel, Orange County lawyer Brian Brandt brought a wrongful death lawsuit on behalf of the young girl and her brother, with her as successor-in-interest following her brother’s death. Recovery was also sought for negligent infliction of emotional distress because of watching her family members burn to death.

The Law Offices of Brian Brandt filed suit against the driver and Bhandal Bros. Trucking Inc., with Carolina Casualty as the insurance carrier. The case went to trial, and Brian called countless witnesses, including a tire engineer, highway safety engineer, neurologist, trucking expert, accident reconstructionist, psychologist, and economist. The truck driver, who had his license for two years at the time of the fatal crash, told the jury at least three different stories as to why he had pulled over on the side of the freeway, including having to sleep, having to urinate, and suffering from a headache. The jury did not find him credible, and in closing arguments, Brian asked for $130 million in damages due to the negligent actions of the driver.

The jury deliberated for three days and found the defendants fully at fault. The jury returned with a significant verdict of $150,750,000 in favor of the plaintiff; this verdict included $8.75 million awarded to the young girl. Brian obtained a verdict that was $20 million more than originally requested.
